In fact they did the right choice if you want to have a directive at all.
The chance to have it accepted as B-item was very small anyway.
If as B-item and re discussion would have happened there would never have been a
qualified majority for either text proposal.
The result would have been that the whole process would have been stopped and
that the SWpat would have been in the hands of national courts.
Luxembourg has chosen to have a directive and will do it's possible to have

Very difficult to say. Constitution might help to not get such cases again as
national parliaments will be involved much earlier in the process.

luxembourgeoise*_
C'est hier que le ministre de l'Economie Luxembourgeois, Jeannot Krecké,
qui présidait la séance du Conseil européen à Bruxelles, a fait adopter
la brevetabilité logicielle (directive sur les inventions mises en
oeuvre par ordinateur). Soutenue par l'industrie (Apple, Dell, IBM,
Microsoft, Nokia,...) la proposition de directive sur les brevets de
logiciels est combattue par un grand nombre d'acteurs locaux et par les
partisans du libre qui estiment que la brevetabilité « créera un
avantage pour les puissants et constituera un frein à l'innovation
logicielle ». Alors que plusieurs pays avaient fait part de leurs
réserves quant à la directive soutenue par la Commission, le débat
d'hier a tourné court. Jeannot Krecké a refusé de porter le débat au
public malgré l'empressement du vice-Premier ministre danois, soutenu
par le Portugal. Le Ministre Krecké a justifié ce refus pour des
« raisons institutionnelles, afin d'éviter de créer un précédent qui
pourrait à terme ralentir le processus de décision de l'UE ». Les
réactions n'ont par tardées : l'enthousiasme des acteurs de l'industrie
informatique d'une part et une opposition déjà farouche du libre d'autre
part. La mouture adoptée est celle issue du compromis de mai dernier sur
les brevets de logiciels, sans avoir tenu rigueur du travail
parlementaire qui est effectué depuis cette date. Cette décision ne
signifie toutefois pas ratification de la législation qui doit retourner
au Parlement pour débat. Un débat qui promet d'être houleux.
« La décision du Conseil, favorable au brevet logiciel, est une gifle
pour la très prospère industrie informatique européenne et pour le
Parlement européen, a déclaré Monica Frassoni, coprésidente du Groupe
des Verts/ALE au Parlement européen. Le Conseil s'est agenouillé devant
Microsoft and co. et a trahi les intérêts des développeurs de logiciels
européens. Le Conseil a ignoré la volonté du Parlement européen alors
que la Conférence des Présidents de cette même institution s'est
unanimement exprimée contre l'adoption de cette directive, créant ainsi
un sérieux conflit entre le Parlement, la Commission et le Conseil. Pour
des raisons purement formelles, les ministres de l'UE ont aujourd'hui
confirmé la position commune datant de mai 2004 même si dans
l'intervalle les circonstances sont radicalement différentes. Le Conseil
a également ignoré l'opposition croissante à l'égard de cette directive
dans de nombreux parlements nationaux préoccupés, à raison, par l'avenir
de leur industrie du logiciel. Le texte actuel de la directive brevet
logiciel ne doit pas faire force de loi. Les Verts vont accentuer la
pression pour s'assurer que la proposition de directive dans sa forme
actuelle ne franchisse pas le stade de la seconde lecture. »

Of course. It's not because we have a corrupt government that
we shouldn't continue to be Luxembourgers. Same goes for the
US people after all.

Outrage and disgust for certain. I'm certainly not ashamed, I
know I did my part for this *not* to happen. I also certainly
would have no problem seeing the people responsible in front
of an EU judge for violation of the procedures.
Btw, there's an article in the LuxBox Hebdo #10 mailing, it's
quite interesting to read. Seems it is Krecké, not Juncker, who
got this through.

AFAIK the referendum is not about the text of the constitution,
but about allowing the governments to continue negotiations (is
that really it?).
So, the text could say this or that in the end, here it's about
the very concept of a EU constitution. From the proposals for the
text, it would seem there's some dangerous stuff in there... so
those proposals I'm none too keen on...

No, the the negotiations will not be continued because they already have
been terminated. The european governements already have signed the
consitution text the 29th october 2004:

The text now needs to be ratified by the national paliaments. Some
countries (Luxembourg included) have chosen to ratify the text by
referendum.
So remember: By saying "yes" you not only agree to the general idea of
having a european constitution (which I think is basically a good idea)
but you agree to a specific law text!

No, the the negotiations will not be continued because they already have
been terminated. The european governements already have signed the

Sometimes I am ashamed. Especially when the national constitution
revision rules are "violated" by a profane "trick" (normally the
constitution is harder to modify than normal law, but smart polititians
have found a workaround ;-):

I somewhat agree to the "fake imitation of a referendum" part of your
comment. The notion of being "favorable to *a* european constitution"
and "accepting *this* particular constitution" are blurred by the press
and ILRES. But it is a big difference to me! Anyways, the majority of
the people having approved the constitution text in ILRES polls have
never read the text and have not been able to answer simple questions
about the constitution text in the same ILRES poll!
I do not know if I will find the time to read the 400 page constitution
text before the 10th July. But even if I do, I am sure that I will miss
the hidden details and tricks that could later be exploited by smart
politicians. I strongly doubt the colourful "summary" brochures sent to
every citizen will help me doing a wise decision what to vote :-(
